These Terms of Use ("Terms") govern your access to and use of KASTOVAI (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and Copyright Policy. If you do not agree, do not use the Service.
KASTOVAI turns recorded VODs and live streams into short-form clips using automated transcription, AI moment selection, and video rendering. Features, limits, and pricing may change over time.
You must be the age of majority in your province or territory to use the Service. You are responsible for your account credentials and for all activity under your account. Provide accurate information and keep it current.

You are solely responsible for the content you submit and the clips you create, download, publish, or post to third-party platforms.
The Service runs on credits and optional subscription plans. Credits are consumed as footage is processed (pay-as-you-go), and you can stop a job at any time. Paid plans renew until cancelled. Payments are processed by our payment provider; by purchasing you authorize the applicable charges. Except where required by law, fees are non-refundable.
KASTOVAI and all associated software, design, and branding are owned by us and protected by law (see our Copyright Policy). You retain ownership of the content you submit; you grant us a limited licence to host, process, and transform that content solely to provide the Service to you.
The Service relies on third-party providers (for example, AI processing, payments, email, and social-media posting). Your use of connected third-party platforms is also subject to their terms. We are not responsible for third-party services.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that clips, captions, or AI selections will be accurate or fit for any purpose.
To the fullest extent permitted by applicable law, KASTOVAI will not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the three (3) months before the claim arose.
You agree to indemnify and hold KASTOVAI harmless from any claim or demand, including reasonable legal fees, arising out of your content, your use of the Service, or your violation of these Terms or any law or third-party right.
You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms or applicable law.
These Terms are governed by the laws of the Province of [Québec] and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. The courts located in that province have exclusive jurisdiction, subject to any non-waivable rights you have as a consumer under the law of your residence.
We may update these Terms from time to time. Material changes will be posted here with a new "last updated" date; continued use means you accept the updated Terms.
